Purchase Terms, Returns and Cancelation Policies

The following are the general contractual terms and conditions governing the sale of our products. The purchase of product becomes a contract between you the buyer and Biophoretics. The contract is created when we accept your order indicated by a confirming order, email acknowledgement or shipping your order. Orders are non-cancellable after 48 hours. If any of the terms are in conflict we will rely on these posted. If your terms of purchase conflict with ours, please contact us for clarification. Our priority is to make sure you get the product you want, when you need it.

Freight Charges:

Many products are temperature sensitive, therefore, Biophoretics ships best way selecting the carrier and method (1d, 2d or Ground) to ensure product integrity, shortest delivery time and least cost to you. You are more than welcome to request an estimate of shipping costs; your actual shipping charges may vary and will be shown in your "Payment Receipt" after shipment is made.

Ship and Add
Surcharges for Dangerous and Hazardous goods, ice, and dry ice will be added per your quote

Our terms our FOB source. Title transfers to you when the product is given to the freight carrier. In most cases this will be Sparks, Nevada. In some cases as when you request a drop ship to expedite delivery the source will be that of the manufacturer. If there is a shipping problem we will work with you and the carrier toward resolution.

Payment & Terms:

Net 30 days on APC, CC, wire transfer, EFT and PAYPAL.

Biophoretics accepts all major credit cards. Please note your credit card is not charged until after your order is shipped. Our ecommerce platform is secure on it's own server with SSL certificate and is independently and randomly audited. To help prevent credit fraud, each credit card transaction is manually scrutinized to identify possible fraudulent purchases.

For credit accounts, if your payment is late we reserve the right to charge a $25 late fee plus 1.5% per month on the outstanding balance, and or refuse to accept further orders until the account is brought current.

Sales Tax:

Biophoretics does not charge sales tax unless you are a Nevada based for profit organization.

Cancelations and Change Orders:

Orders can be canceled or changed before shipment. If changed or canceled after shipment and within 5 days after receipt, Biophoretics will accommodate the return and/or change. Customer (end user) may be responsible for return shipping costs and a 15% restocking fee whether the order is placed directly with Biophoretics or a distributor. Restocking and return shipping fees do not apply to distributors such as ThermoFisher, Sigma Aldrich, VWR etc.

Orders for custom, special and bulk products maybe changed within 24 hours after placement. After that they are not cancelable or changeable.

Returns:

Products can be returned for shipping damage or product failure under warranty.

If due to shipping damage, please send us a photograph and we will report to the shipper and try facilitating replacement. However, Biophoretics is not responsible for lost or damaged goods as a result of shipper’s failure. We strongly suggest you request shipping insurance when you place your order.
If due to product failure, Biophoretics will either replace or have the product repaired by the original manufacturer. No cash refunds will be made. Please inspect your product upon receipt. You have 5 business days from receipt to obtain return goods authorization (RGA) which is required to return your order. In this case, Biophoretics pay for the return shipping costs.
Non-returnable products: Orders for custom, special and bulk products and opened, refrigerated or frozen chemicals and reagents.

Pricing:

Our prices are posted on the website or in a written quote. Prices may change at Biophoretics sole discretion and our prices do not include tax or any other government assessments.

Use:

Unless otherwise stated on the product, the products sold are not for human or animal consumption. They are for research and manufacturing purposes only.

Warranty:

The products Biophoretics distributes are warranted by the original manufacturer. In the event of a product failure, notify us, and we will work to arrange repair, replacement or other acceptable remedy provided by the manufacturer. Please make any claim in writing to customerservice@biophoretics.com .

Limited Liability:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIOPHORETICS WILL NOT BE LIABLE UNDER ANY LEGAL THEORY (INCLUDING BUT NOT LIMITED TO CONTRACT, NEGLIGENCE, STRICT LIABILITY IN TORT OR WARRANTY OF ANY KIND) FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, MULTIPLE, EXEMPLARY OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO COSTS OF COVER, LOST PROFITS, LOST DATA, LOSS OF BUSINESS, LOSS OF GOODWILL OR LOSS OF REVENUE) THAT YOU MIGHT INCUR UNDER THE CONTRACT, OR THAT MAY ARISE FROM OR IN CONNECTION WITH OUR PRODUCTS OR SERVICES, EVEN IF WE HAD NOTICE OF THE POSSIBILITY OF SUCH DAMAGES. IN ADDITION, OUR MAXIMUM AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE CONTRACT, OR ANY PRODUCT OR SERVICE, IS LIMITED TO THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE PURCHASED. HOWEVER, THESE PROVISIONS DO NOT LIMIT OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE OR FRAUD, FRAUDULENT MISREPRESENTATION OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED BY LAW.

DELIVERY DATES AND TIMES ARE ESTIMATES ONLY AND BIOPHORETICS WILL NOT BE LIABLE (IN CONTRACT, DELICT, TORT OR OTHERWISE) FOR ANY LOSSES, EXPENSES, CLAIMS OR DAMAGES CAUSED BY A LATE DELIVERY.

IN ADDITION, OUR MAXIMUM AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE CONTRACT, OR ANY PRODUCT OR SERVICE, IS LIMITED TO THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE PURCHASED.
